By accepting the Terms of Use through use of the site you certify that you are 18 years of age or older. If you are under the age of 18, but at least 13 years of age, you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by the Terms of Use. It is not the policy of Consignment Furniture® to knowingly collect personal information of children under the age of 13.
Accounts
You have the option to register an account with a username and password if you choose. You are responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities that occur under this account. You agree to immediately notify Consignment Furniture® in the event your personal information changes or you suspect unauthorized use of your account.
Purchases
You may place orders for products and/or services offered by Consignment Furniture® via the Site. An order or orders shall mean any purchase made by you for products and/or services from the Site that is accepted by Consignment Furniture®. Upon placing an order, you will be required to pay to Consignment Furniture® the order total as set forth in the shopping cart. Consignment Furniture® will make every effort to prevent fraudulent actions and may require additional verification or information before accepting your order. Consignment Furniture® may utilize the services of certain third-party payment processors to process payments of credit cards and other accepted methods of payment. Your purchase is subject to the terms and conditions of these third-party payment processors. Prices and availability of products are subject to change without notice. Consignment Furniture® will correct errors when and where discovered and reserves the right to revoke any stated offer, correct any errors, inaccuracies or omissions including after an order has been submitted, whether or not the order has been confirmed and your payment method has been accepted and charged. In the event your payment method has been charged, Consignment Furniture® will issue the appropriate credit within a reasonable time after your order has been cancelled. You hereby agree to represent and warrant to Consignment Furniture® that you are an authorized signatory of the credit, debit card or other method of payment that you provide to Consignment Furniture® or its third-party payment processor to pay the total purchase price and any applicable fees or taxes related to your purchases of products/services via the site. In the event you purchase a product that must be delivered to you, such products will be shipped to you by Consignment Furniture® and/or its third-party contractors within a commercially reasonable time after processing of your order. Delivery time may vary depending on the delivery method selected and product availability. Consignment Furniture® does not guarantee delivery at any certain time and is not responsible for delivery delays or damages.
Delivery
Consignment Furniture® begins processing your delivery two (2) days prior to the delivery date. Before merchandise can be delivered, it must be paid in full (or financing arrangements completed) by 7 p.m. two (2) days prior to delivery. If you choose delivery, Consignment Furniture® is not responsible for anything that happens after item(s) leave the store. Anything that happens to the item(s) after leaving the store are between buyer and the delivery service chosen.
Pick Up
If you are picking up your merchandise:
1. Visit our website for the hours our stores are open. You will need to bring ample help to load your purchase. Consignment Furniture® is not responsible for the loading/securing/unloading of your items.
2. Bring your receipt to the cashier counter for processing and loading instructions.
3. Provide a valid ID
4. The cashier will provide you with a ticket for your signature.
Consignment Furniture® will not tie down or secure items on your vehicle. Anything that happens during loading/transporting/unloading of the item(s) is the sole responsibility of the person(s) loading/transporting/unloading the item(s).
Items not picked up within 48 hours will be returned and a refund will be issued minus a 25% restocking fee.
Online Credit Card Transactions:
1. The cardholder must be present at the time of pick up.
2. The credit card that was used for the online payment along with a valid ID will need to be presented for verification.
Valid forms of Identification:
1. Driver’s License
2. State Issued ID
3. Federal Government Issued ID
Please note that the item(s) will not be released for pick up if the above requirements are not met.
Returns/Exchange Policy
All sales are final. No refunds, no exchanges, no returns. Item(s) purchased online have been available to view in store. If buyer chooses to purchase sight unseen, they accept item in condition as shown in photos.
Content and Pricing Information
Although Consignment Furniture® strives to provide accurate pricing information on its Site, pricing or typographical errors may occur. Consignment Furniture® cannot confirm the price of an item until after you order. In the event an item is listed at an incorrect price due to an error In pricing, Consignment Furniture® shall have the right, at its sole discretion, to refuse or cancel any orders placed for that item. In the event of a pricing error, Consignment Furniture® may, at its sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Consignment Furniture® attempts to be accurate in its product descriptions, including dimensions and color in photos; however, Consignment Furniture® does not warrant that product descriptions, product images, product pictures or other content of the Site is accurate, complete, reliable, current, or error-free.
Colors
Consignment Furniture® has made significant efforts to accurately display the colors of our products that appear on the Site. However, as the actual colors you see will depend on the specifications of your monitor/device, Consignment Furniture® cannot guarantee that your monitor/device’s display of any color will be accurate.
Quantity Limits and Dealer Sales
Consignment Furniture® reserves the right, at its sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and to orders that use the same billing and/or shipping address. Consignment Furniture® will provide notification to you should such limits be applied. Consignment Furniture® also reserves the right, at its sole discretion, to prohibit sales to dealers or resellers. For purposes of the Terms of Use, reselling shall be defined as purchasing or intending to purchase any product from Consignment Furniture® for the purpose of engaging in a commercial sale of that same product with a third party.
Indemnification and Termination
You agree to defend, indemnify and hold harmless Consignment Furniture® and its subsidiaries and affiliates from and against all claims, damages, costs and expenses, including attorney’s fees, arising from or related to your use of the Site or any breach by you of the Terms of Use. The Terms of Use are effective unless and until terminated by either you or Consignment Furniture®.
You may terminate the Terms of Use at any time, provided that you discontinue any further use of the Site. Consignment Furniture® may also terminate the Terms of Use at any time and without notice, and may deny you access to the Site, if in Consignment Furniture® sole discretion you fail to comply with any term or provision of the Terms of Use.
